Those qualities are combined with a tradition of personal service which dates back to the firm’s roots in the 19th century. Babbé fields a team of established practitioners who are acknowledged experts in their fields. That team continues to be strengthened by a policy of acquiring highly experienced top-flight lawyers who can add real value.
The firm’s clients include multinationals, SMEs, entrepreneurs, banks, fiduciary companies and insurers. Instructions flow directly from clients and from referrals, frequently involving major City law firms.
Types of work undertaken: Corporate work includes: acquisitions and disposals; restructurings and insolvency; taking security, migrations and complex share transactions; and capital markets, including CISX, AIM and Official List.
Banking transactional work includes: lending (bilateral and Syndicated); trade and commodity finance; leveraged finance; investments; structured finance and securitisations.
Insurance work includes: advising captives and captive managers in relation to corporate governance (including PCCs and ICCs) and regulatory issues. The firm has wide experience of the insurance market and acts for most of the leading players.
Funds: The firm has recently increased its funds capacity significantly and now advises a number of island industry participants and overseas sponsors and investors. It has a capacity to provide a rapid response to clients seeking advice in this field. It deals with the usual range of fund structures and types.
Trusts and fiduciary: Babbé has a unique position amongst Guernsey’s larger law firms in not operating its own trust company in competition with its clients. Because of this its trust practice is highly valued for the quality and robust independence of its advice. It advises many corporate trustees in matters including: formation and structure of trusts, including complex international trust; formations of companies and appointment of administrators; drafting of instruments to effect resolutions; compliance; ongoing trust administration. The non-contentious group works hand in hand with the litigation team in contentious fiduciary matters.
Commercial and trust litigation: the exceptionally strong litigation team is active in the areas of banking, trusts and insurance, whilst also undertaking a wide spread of general commercial work. It is frequently involved in asset tracing, injunctive relief, cross-border insolvency, professional indemnity and assistance in foreign proceedings.
Commercial property: Babbé has acted on virtually every major recent commercial property transaction in Guernsey. The property and corporate team recently acted for the purchaser in the most expensive commercial property transaction in Guernsey to date.
